"In general, software licenses and other cultural works are grouped into two distinct fields: some seek to limit the user's freedom to share and change the works to which he has licensed access; others aim precisely to ensure that freedom to share them and modify them, respected certain conditions set out in the license.

Assuming a generic understanding of freedom that these licenses wish to protect, nevertheless none of them explains the fact that the exercise of human freedom, strengthened with the use of works licensed under them, may occur either as a practice of domination or as a practice of liberation of other human beings, as a practice of destruction or protection of ecosystems, as a practice of annihilation or promotion of the cultural diversity of individuals and peoples.

The Copysol License avoids falling into this paradox of protecting freedoms that are exercised annihilating other freedoms and rights. The Copysol ensures that cultural works, carried out and made available for the solidary purpose of benefiting people, of protecting the ecosystems and the interculturality, i. e., to promote the public good, cannot be used in practices of exploitation and domination of other humans beings, or under unsustainable interventions on the ecosystems or annihilating cultural diversity, because these practices violate the ethics of liberation, under which the Copysol License is positioned and the distribution of products covered by it.

The emphasis of Copysol license is thus not just the legal assurance of freedom of the users to know, use, modify and reproduce licensed works, but also the requirement that the user's freedom to use the work is carried out without violating the right of freedom inherent in each person. This right unfolds and is objectivated in other economic, social, environmental and cultural aspects that must be protected. This is so, because the assertion of a generic freedom right, without any solidarity guarantee of the conditions required for its effective realization, ends up necessarily in the real and concrete denial of that same right ideally stated.


Thus, rather than just laisser faire what each one wants with the works accessed under the license or restricting legally its commercial use to avoid the accumulation of profit with them, the Copysol license intends to protect the public and private freedoms against the violation of the right to liberation of each person, violation that could occur with the use of licensed works themselves.

The Copysol licensing aims particularly to protect the exercise of the Article 27 of the Universal Declaration of Human Rights, which states: "(1) Everyone has the right freely to participate in the cultural life of the community, to enjoy the arts and to share in scientific advancement and its benefits. (2) Everyone has the right to the protection of the moral and material interests resulting from any scientific, literary or artistic production of which he is the author.". Thus, if the moral interest of the author on the licensing of his work is that it be used in the promotion of public and private freedoms ethically exercised, such rights may not be violated by the user of the work or of its derivate products.


What we wish with this licensing mechanism, with regards to the solidarity patrimony generated under it, is the co-responsability of the users in promoting public and private freedoms ethically exercised, in accordance with article 29 of the Universal Declaration of Human Rights, which States: "(1) Everyone has duties to the community in which alone the free and full development of his personality is possible. (2) In the exercise of his rights and freedoms, everyone shall be subject only to such limitations as are determined by law solely for the purpose of securing due recognition and respect for the rights and freedoms of others and of meeting the just requirements of morality, public order and the general welfare in a democratic society."


The formal recognition and respect of public and private ethical freedoms of the others and the material promotion of well-living of the people and human communities in a solidarity-driven way can not be denied in practice with the use of products licensed under the Copysol.


Thus, the use of solidary software, for example, can not violate the right to confidentiality of private communications between people, a right violated daily by companies that provide electronic mail services, both with proprietary software or with open source software, every time they intercept messages from the users with robots that crawl content to offer customized advertising services to corporations that are their clients or strategic information to Governments and their military apparatus - even if such violation is legally supported, as implicit or explicit derivations of the Terms of Service offered by these corporations.

The use of the Copysol License aims explicitly to assure the user freedoms to distribute copies of the licensed products, to have access to the source code of the licensed programs, projects and designs related to the making of tangible and intangible products, modify such licensed products and integrate them, partially or completely, in new solidarity products, to produce such tangible or intangible works, to reproduce and distribute these goods produced. Ensures to the user the right to know these rights are available to him and to access this License in its integrality.


On the operationalization of the license, developers of licensed products should protect their rights, declaring their copyright on the product and declaring its distribution under this License - which ensures the legal permission for others to use, copy, modify, make, distribute, exchange and sell the product as described in this License. As in other licenses, Copysol explains the absence of guarantees in the use of the licensed products - in order to protect and prevent respectively developers and users of the products. This process also requires that modifications made on the distributed products be clearly documented, in order not to have the attribution of new efficiencies to failures of authors of previous products, which originated the products derived by third parties.


The use of this license also prohibits to patent solidary products denying the freedoms protected therein. The subsequent authorization by States for patent products previously protected under this license, deny the rights guaranteed therein, and is characterized as a violation of Article 27 of Resolution 217 of the Universal Declaration of Human Rights adopted by the General Assembly of the United Nations on December 10, 1948 - which provides that “Everyone has the right to the protection of the moral and material interests resulting from any scientific, literary or artistic production of which he is the author”. So, the author has a right to decide about which use license of their cultural product best ensures public and private freedoms, which he want to protect in its whole."

The Copysol License is applicable to software and other classes of digital works legally covered under it, such as projects and / or designs of tangible and intangible objects, organizations and processes. The different elements covered under the Copysol license are referred as "Products”.

As human beings are concrete subjects, of flesh and blood, the exercise of their freedom requires material conditions without which that freedom cannot be exercised. Part of these conditions are served by ecosystems and part is produced by human labour.

Given that cultural products licensed under Copysol are materials means at the service of the public and private freedoms, the license does not allow the use of such products in ecosystem degradation or in forms of economic domination of workers, in which people who work cannot decide freely about their own working lives, since they are subordinated to the economic power of those who hire legally or illegally to compel them to a menial work in forms of wages, slavery or semi-slavery. The legal consent of States in the economic exploitation of the subordinate labor of others, in which humans are taken as a means for profit by a third party and not as an end in themselves, does not change the unethical character of this form of economic domination and in no way denies the inalienable right to economic liberation of every person and of all peoples.



Therefore, in the spirit of the moral and material protection of the author's interests who offer their scientific and cultural products to the human community, in order to expand public and private freedoms performed ethically, this license also prohibits the use of these products as a means of obtaining profit with the exploitation of the subordinate labor of others, whether child or adult.

This license ensures, on the other hand, the right to know, use, copy, modify, make, distribute and sell such products, with all the freedoms and conditionalities set out in this license for any of solidarity economy enterprises that operate under democratic principle of self-management, regardless of the legal form of the registration of such initiatives. Self-management, as the democratic principle of the solidarity economy initiative, is verified by the periodic occurrence of assemblies - or other equivalent mechanisms of decision - where workers have the right to decide, on an equal basis and power, everything that is related to the economic activity, management, property, tangible and intangible assets of the initiative, company or organization.


This system of licensing, joint ownership and solidarity distribution of licensed products contributes to the strengthening and expansion of the solidarity economy in which the initiatives are organized democratically on the principle of self-management. It also contributes to self-managed sharing of the economic means and economic values, generated with the use of licensed products, aiming to the well-living of the people, promoting the expansion of public and private freedoms, ethically performed, with the mediation of such means. Furthermore, it contributes to the ecologically sustainable development of human communities, avoiding that these products (programs and others forms) are used under the logic of global economic competition which is progressively destroying the planet.

Users and developers, in the spirit of this license, are invited to collaborate in a solidarity way on improving the solutions obtained. Their participation with this end into collaborative networks of solidarity economy is a possibility that we encourage. We encourage the organization of self-managed initiatives of solidarity economy that will supply the economic needs of the humanity as a whole - including the needs of information technology - with techonolgies licensed under the Copysol License, ensuring its free distribution, modification, reproduction and use of products under this license, to collaborate in the production of material means to assure and expand public and private freedoms of present and future generations.


Thus, as a consequence, the Copysol license allows the licensed products under it to flow freely in solidarity collaborative networks, in the fields of economy, politics and culture, contributing to the construction of new possible worlds, based on the right to freedom and ethics, in which the whole set of the human rights is ensured. On the other hand, the Copysol license prohibits companies who deny the democratic and solidarity principle of self-management of workers, to use solidarity technologies as a means of private accumulation of capital with the exploitation of subordinated labour, as has been done with the use of proprietary software and [in some cases] free software.


It should be noted that the licensing under Copysol is fully democratic, isonomic and respects the freedom of private producers of licensed works who make them available to the public good. Unlike the unilateral vetoes associated to the use and marketing of many proprietary softwares that prevent actors, for example, from the possibility to "... export or re-export the components [...] to any country, person or entity subject to United States export restrictions" – restrictions which are based on interests of economic, political or military order –, the veto set out in Copysol to ensure the freedom of producers and also their moral and economic rights on the products that they offer freely to the Commons, requiring also that the human community use these products for the ethical promotion of the public and private freedoms of all.


In the countries where the freedoms guaranteed in the Copysol License conflict with legal restrictions, we encourage civil society to democratically press the appropriate instances to change the laws so that they are based on ethical grounds, and protect and promote all the public and private freedoms.


Even in the case of conflicts between the freedoms guaranteed in this license and the legal restrictions in one country, the terms of this license may not be violated by States or Corporations of any nature. Because in the same way that international law protects the private agents that enforces restricted conditions of use and trade of their products with third parties in compliance with legal regulations of their country, it also protects the private agent – in this case, the author and owner of a licensed product under Copysol – which, invoking article 27 of the Universal Declaration of Human Rights, may impose constraints on the use and marketing of their product to third parties. These constraints are grounded on isonomic criteria, assumed in this license, based on ethical and ecological conditions that aim to promote public and private freedoms exercised in a solidaristic way. It contributes to cancel the economic exploitation of the labour, economic and social exclusion and the global degradation of the ecosystems.


We encourage scientific, technological and economic development, consistent with the ethics of liberation, that contributes to ensure and protect the right to liberation of every person and of all peoples, rather than being at the service of the accumulation of capital by private agents or the empowerment of the military-industrial complex in the world as a whole.

HISTORY

The version number 1 of the Copysol License was written by Euclides André Mance, in the year 2000, gathering contributions of dialogues held with in the Institute of Philosophy of Liberation [IFIL]. This version was used for the first time on that year as legal support in the distribution of the software Rede Solidária (Solidarity Network), ensuring rights to use, modify and distribute the program within the solidarity economy initiatives. On the other hand, the license granted to any person or organization, without distinction, the right to distribute the program with a similar policy of shareware distribution.


The original preference in that time was to adopt the GPL as the distribution licensing, adding a clause that excluded companies and organizations, which do not adopt the self-management peculiar to solidarity economy, of any right over the licensed products. However, as it was not possible to establish this exclusion clause with the GPL license, the Copysol License was updated to this version 2, retaining its original spirit, but also expanding its range to licensing also to projects and designs, to tangible or intangible products, besides software and IT products.


This version n. 2 is used by the Solidarius International Network for the licensing of a part of its products.

TERMS AND CONDITIONS

Definitions

"This license" refers to version 2 of the license Copysol.

"Copyright" means a right of copy conferred to a person or entity on the registered product, through a legal instance of protection of that right.

"Product" refers to a work subject to copyright and licensing under the terms of this license.

"Licensee" refers to who provides the licensed product.

"User" refers to individuals or organizations, real people or legal entities that use of the product.

"Producer" or "Developer" refers to those who have created the licensed product or made any modification on the product received, even if they don't share such change with another user or developer.

"You" refers to those who utilize the product, whether as user, developer or producer.

"Make the product" means to make it suitable to use as tangible or intangible object according to the nature of the product, to it's project, design or program.

"Modify" the product means adapt the product, fully or in part. The result of the modification is called a "modified version" of the product or "derived product".

"Reproduce" the product means multiply it, with or without modifications.


"Distribute" the product means to make it accessible to the user, or copies of it, or offer the use or access to it in environments where the user can employ it and download its source codes, in the case of software, or project and design in the case of tangible works.

To "Document" the product means to provide, in a clear and visible way, the information that the work used or accessed falls under this license-showing the appropriate Copyright and Copysol notices -, inform about the lack of guarantees on the use of the work and on the guarantees offered by third parties, if they exist, as well as the option to access this license.


"Source code" of an informatics product means the sequence of programming instructions to be processed by the hardware and that is written by the programmer or developer, constituting the licensed product, including its interface, specific instructions and associated routines.

By "Ethics of liberation" we understand the set of principles, adopted in the relationship of human beings with one another and with the ecosystems, which is aimed at protecting the public and private freedoms ethically exercised, promoting the well-living of every person and the sustainability of different ecosystems. Such ethical principles, throughout the history of mankind, have been formulated and corrected dialogically, so to always protect – and protect the better conditions - solidarity equality of rights between human beings and equal decision-making power among all the people in the economic, political and cultural fields for the benefit of the well-living of all.

By "Right to Liberation" we understand the inalienable right of all human being to ethically expand their freedoms, taking advantage of the licensed product, without harming the freedoms, ethically exercised, of other persons and human communities. In the context of economic relations the right to liberation unfolds on the right to autonomy and to self-managed work in solidarity economy enterprises and to enjoy healthy and efficient products, which does not result from the exploitation of human beings or ecosystem degradation. In the context of political relations, it unfolds in the right to autonomy, in the sphere of private life and self-management in the sphere of social life, exercising it into public in economic, politic and cultural fields. In the sphere of the relations of education, communication and information, it unfolds in the right of each person to participate on equal terms in the access to information, its interpretation under different perspectives and in the production of cultural content, performed into full exercise of its public and private freedoms ethically conducted.

By "ethically exercised public and private freedoms" we understand the freedoms which are performed respecting the ethics of liberation and the right to liberation, aiming at contributing in sustainable reproduction of material, political, educational-informational-communicational and ethics conditions required for the exercise of the freedoms of every and each person in particular.

By "Solidarity Systems of Production, Trade and Service", we understand all forms of labour organisations based on the democratic principle of self-management, both of the activity and of the economic enterprise by the workers, which is verified by the occurrence of assemblies - or other equivalent mechanisms - where workers to have the right to decide, on an equal footing and power, everything that refers to economic activity, management, property, tangible and intangible assets of initiative, company or organization; and who carries out this self-management aiming to promote the economic, ecological and social sustainability of the initiative in favor of the well-living of all that are achieved by their economic flows, both the participants of the enterprise, as their providers, customers and communities.

"Project or Design of Tangible Product" is the project or design of something that could be done objectively or analogically, as the design of an object, such as a piece of furniture or a tool, or the project of an organization, such as a sustainability plan of an economic enterprise, or a process, as a permcultural design of an ecological cultivation of food. The Project or Design, as intangible product, differs from what is tangibly performed based on them. This license, since to confer rights and duties to the intangible product, also propagates the same rights and duties towards the intangible elements of tangible products building upon it.

1. Assurance of Rights

The rights guaranteed by the Copysol license refer to rights of the author of the product, being irrevocable as soon as the author carries out the distribution of product under such license, ensuring to any user or developer the possibilities of use, modify and distribute the product in its original or modified form in whole or in part, under this license.


The content generated with the use of the licensed products under the Copysol license, without the partial or complete incorporating of such products as part of the contents, remains under the control of the author. The content so generated by the author falls under this license since he isa licensing it, publishing his work under the shelter of this license. However, no author can make use of products licensed under the Copysol to generate content in contradiction to the ethical and legal terms set out in this license.

To license the Product under the terms of the Copysol license, the producer waives the legal powers available to them to prevent the knowledge, use, modification, performance, reproduction, distribution and marketing of the product as well as its incorporation in other products under this same license by individuals or legal entities qualified to do so under the terms of that license.

1.1 Right to the Knowledge

The right to knowledge the product is assured by the availability of its source code, if the product is a computing code, or by the availability of the project or design, if the product is related to perform any derived tangible or intangible product.

Knowledge of the program source code

The source code of the computer program and installation information should be made available without requiring passwords or special keys for your reading, allowing the user and/or developer understand their operation and distributes it with or without amendments according to the terms of this license.

Knowledge of the Project or Design for realization of Tangible or Intangible Product

The Project or Design to generate a derived tangible or intangible product must be provided in the documentation with the technical specification required making it possible for the user and/or developer to understand its functionality, check its consistency, modify it or distribute it with or without amendments and carry it out according to the terms of this license.

1.2 Right to the Use

The right to free use of the product is ensured to any individuals and companies in the ethical and legal terms of this license.

The author of the Product, for ethical questions, invoking the article 27 of the Universal Declaration of Human Rights which protects their moral rights over the work produced by him, reserves the right of not to grant permission for rights to use the licensed product under the Copysol to any enterprises, groups, organizations or any particular subject that violate the principles of the Ethics of Liberation and of the Right of Liberation The licensed Product cannot be used or marketed in non-solidary systems of production, trade, service or consumption. The use of the product in disrespect of this requirement is characterized as a violation of rights, subject to legal penalties prescribed by international agreements on copyright.

1.3 Right to the Modification

The right to free modification of the Product is assured to any individuals or entities in the ethical and legal terms of this license. Any translation, plagiarism or modification of the Product which gives rise to derived product which, in whole or in part, follow the same standards of the licensed product – in particular the logical relationship and proportions between factors or algorithms adopted it – should also be distributed under Copysol regime.

It is allowed to modify the product or create a new work based on it, copy it and distribute it, though: a) the Copysol is maintained, covering the integrity of the new work with the same content of the original license; b) there is a warning about the change of the original data in the files, the approximate dates of that change and who operated it; c) there is warning that the new work is so wholly or in part, derived from the Product or of any part of it, and that it can be licensed as a whole, under the terms of this license, without charge to third parties; d) the copyright and Copysol information present at the beginning of its execution or in visible place in the interface, if a program, or on their documentation if a design or project of tangible product, and indicate the location of the documentation on the conditions of the use, registry and reproduction; e) include in its documentation this license.

1.4 Right to copy and distribution.

The right to copy and distribute the Product under the ethical and legal terms of this license is assured.to any individuals and entities.

The complete source code should be available in any distribution of the product, if it is a software, For complete source codes understand all sources of all modules, as well as the associated interfaces settings, files and scripts used in the compilation and installation of the software.

The distribution of the product must include all copyright information, this License, the notice of Absence of Warranty and its history, indicating the changes, approximate date in which they were carried out and the responsible for them.

Any company or organization, solidary or not, can freely distribute the product without charging any fee or value and without obtaining any commercial advantage with this distribution, including those related to advertising or image association in marketing practices of social responsibility.

It is permitted to charge or not some value for the copies that you distribute or any fees for support or warranty related to the product. But you can't impose license fee, royalties or any other charge or restriction to the exercise by the receiver of the rights granted in this license, or trigger it legally by patent infringed by reason of the receiver use the product under this license.


The receiver of the Product is also covered under the License to copy, modify, execute, perform and distribute the product.

Modification or distribution of the Product, or any work on it based, implies acceptance of this License in its all terms to perform the copying, distribution or modification of the Product or work based on or derived from this work.

1.5 Right to realization

The right to realization of the product is ensured to any individuals and entities in the ethical and legal terms of this license. The performer of the product assumes the responsibility of checking the consistency of the project or design before performing it and taking care of safety and legal arrangements which are necessary for the realization of the product, regardless of them being listed or not on the project.

The tangible or intangible achieving of the something derived – with or without modifications – from a product licensed under the Copysol is the sole responsibility of the performer, which must verify the consistency of the project or design before its execution, running at your own risk everything that may result from this implementation and the use of the object held, particularly damages affecting themselves or others as a result of project or design flaws or of any element associated with the project or design licensed.

1.6 Right to the Commercialization

The achievement of licensed products, when operated for commercial purposes, is permitted only for initiatives of solidarity economy characterized by the practice of self-management. Components of the work can be from State initiatives or for purposes of profit, but the economic outcome of the process and the democratic management of the enterprise should be subordinate to the self-management by workers who perform the final product.

We encourage the organization of economic initiatives of solidarity character which allow attend the final consumption needs for the well-living of the persons and attend the production of raw materials and components which have not achieved in the local and global circuits of solidarity economy. We encourage also the organization of these initiatives in collaborative networks of solidarity economy which are contributing to expand the solidarity economy in all continents.

1.6 Protection of Rights.

It is prohibited the incorporation of the Product, if it is a program, in proprietary programs. Is allowed to do its unification with others, since the resulting program is made available under the Copysol regime, remaining in force for him the terms of this license. A software or covered code under license Copysol can be executed with the help of free or proprietary systems and libraries.

Separate modules of solidarity codes and free codes can interoperate without contamination of such licenses. The use of solidarity software with free software in interoperability does not exempt the user from conditionalities of use set forth in this license.

We encourage the developers to create solidarity solutions for the needs that have not yet free alternatives. And integrate the existing free solutions and solidarity solutions in its interoperability, respecting the differences of licenses, without harming the different philosophies of development and legal distribution supported on the different licenses.

4. Revocation of the License

You can only use the product in accordance with the terms of this License. If you violate this license, any copyright holders of the product may notify you and after 60 days revoke the rights granted to you by this license and denounce you legally by violation of rights in reason of misuse of the product. On the other hand, if you correct the violation within 30 days of receipt of the notification, and do not repeat this violation, the license will be automatically restored to you. While their rights are not restored, you're not qualified to receive another license for the same product.

The versions of this license are numbered, and the author can choose the version that he want to licensing his product, governing the coverage by the terms of the respective license.

The disclaimer of the warranty and limitation of the responsibilities characterise, in conjunction, the absolute, complete and total renunciation of any liability in connection with the product, except that explicited on statement of responsibility or guarantee which accompany the copy of the product, in exchange for a service charge, legally and formally contracted between the parties.
